Preamble
This notice is given pursuant to Article 13 of European Regulation no. 2016/679, laying down provisions for the protection of individuals and other subjects with regard to the processing of personal data, and to Recommendation no. 2/2001 of the Working Party set up under Article 29 of Directive 95/46/EC. The Data Controller, named at the end of this notice and hereinafter referred to as the “Agency”, is required to give clients (hereinafter “data subjects”) the information they need about how this website is run as regards the processing and use of the personal data of those who visit it.
1. Where the data collected by the Agency comes from, and how it is used
This site has no contact forms: the personal data you provide to the Agency can only reach us through the messages you choose to send to the email addresses published on the site, or by telephone. By writing to us you disclose the data contained in your message and agree to it being processed so that you can receive a reply. Any consent to promotional and commercial communications from the Agency is separate and entirely optional: it does not affect the reply to your enquiry, entails no adverse consequence for you and, if given, may be withdrawn at any time upon your express request. Under the rules referred to above, the personal data you provide will be processed as part of the Agency’s ordinary professional, administrative and promotional activity, and that processing will follow the principles of fairness, lawfulness and transparency, protecting your privacy and your right to the protection of personal data.
2. Purposes and nature of the processing
For its institutional purposes, connected with or instrumental to its activity, the Agency will process your data in order to: a) reply to your enquiry and comply with obligations laid down by law, by regulations and by European legislation, as well as with instructions issued by Authorities legally empowered to do so or by supervisory and control bodies; b) promote the Agency’s products and services by sending advertising material, or through telephone contact and any other form of electronic communication (email, SMS, MMS, WhatsApp). The processing under letter a) is necessary: without the data required we cannot act on your enquiry. Refusing the processing for the purposes under letter b) is optional, entails no adverse consequence for you and may be withdrawn at any time in the manner set out in this notice.
3. How data is kept, and for how long
The personal data you provide may be collected and stored on paper and by electronic and telematic means, following logic strictly related to the purposes of the processing and, in any case, in such a way as to guarantee its security and confidentiality. Your data will be used solely for the purposes for which you gave your consent and will be erased at any time upon your express request. Pursuant to Article 13(2)(a) of the Regulation, the retention periods for the various purposes are as follows: for the purposes under letter a) of point 2, data is kept for as long as is needed to manage the relationship and to comply with legal obligations; for those under letter b) of point 2, the retention period is set at 10 years.
4. Browsing data
The computer systems and software procedures that run this website acquire, during their normal operation, certain personal data whose transmission is implicit in the use of Internet communication protocols. This information is not collected in order to be associated with identified data subjects, but by its very nature could, through processing and association with data held by third parties, allow users to be identified. This category includes, for example, the IP addresses or domain names of the computers used by those who connect to the site, the URI (Uniform Resource Identifier) addresses of the resources requested, the time of the request, the method used to submit the request to the server, the size of the file returned, the numerical code indicating the status of the server’s response (successful, error, and so on) and other parameters relating to the user’s operating system and computing environment. This data is used solely to obtain anonymous statistical information on the use of the site and to check that it is working properly, and is erased immediately after processing. It may be used to establish liability in the event of hypothetical computer offences. The legal basis for the processing is the controller’s legitimate interest.
Cookies
The Agency’s use of cookies falls within the processing of personal data. You are advised to read the extended cookie notice, reachable from the button at the foot of this page and from the link in the footer of every page of the site.
5. Disclosure and dissemination of data
The Agency will not in any way bring your data to the knowledge of unspecified parties, including by making it available or open to consultation, save with specific, free and informed consent given by you for each type of processing. Strictly where necessary, the data may be processed by the provider hosting the site and our email, acting as a data processor, and — where an instruction follows — by the professionals involved in the transaction: notary, surveyors and lenders.
Third-party content
Property pages include a Google Maps map. The map is not loaded until you consent: if you choose to load it, Google receives your IP address and may set its own cookies, including transfers outside the European Union. Details are in the cookie policy. Typefaces are hosted on our own servers and involve no third-party requests.
6. Rights of the data subject
Within the limits and under the conditions laid down by the Regulation, the Agency guarantees and recognises the exercise of specific rights. In particular, the data subject may obtain confirmation as to whether personal data concerning them exists and request that such data be made available in intelligible form. The data subject may also ask to know the origin of the data as well as the logic and purposes on which the processing is based; to obtain the erasure, anonymisation, restriction or blocking of data processed unlawfully, as well as the updating, rectification or, where there is an interest, the completion of the data; to obtain its portability; and to object, on legitimate grounds, to its processing. You also have the right to lodge a complaint with the Italian data protection authority (www.garanteprivacy.it).
7. Data controller
To exercise the rights listed under point 6 you may at any time contact the data controller, Alfredo Di Francesco, sole trader, owner of the Casaitaly.it® trade mark and of the casaitaly.it website, with registered office at via Ogaden 15, 00199 Rome, or by email at associati@casaitaly.it.
